Tune Tornado takes your privacy seriously.  We understand and share your concern about how information about you is collected, used and shared.  We have prepared this Privacy Policy to let you know our policy regarding information that is collected on our website located at (the "Service"), and through your use of the Service. All capitalized terms not otherwise defined herein shall have the meaning given to them in the Tune Tornado Terms of Service.


Information That You Provide Which is Covered by the Privacy Policy

Personal Identifiable Information

We collect personally identifiable information (“PII”), such as your name, zip code and email address when you voluntarily choose to register for use of the Service and when you contact us with comments or inquiries.  If you purchase music through the Service, or in order to qualify for Rewards, we will also collect PII about the songs you purchase, the price you pay, and the date and time of purchase.  Also, if you make Referrals through the Service, we will collect PII about the songs you refer, the email addresses you refer them to, and the amount and source of Rewards that you earn.  If you receive Rewards, we may also collect your address and if necessary, tax identification information.

We never request or store your credit card or bank information.


Passively Collected Information

When you interact with the Service, we receive and store certain additional personally non-identifiable information.  Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you.  Examples include IP addresses, browser types, referring sites, date & time of access, and other anonymous statistical data involving your use of the Service.



In operating the Service, we may use a technology called "cookies”.  A cookie is a piece of information that the Service gives to your computer when you access the Service.  Our cookies help provide additional functionality to the Service and help us analyze Service usage more accurately.


On most web browsers, you will find a "help" section on the toolbar.  Please refer to this section for information on how to receive notification when you are receiving a new cookie and how to turn cookies off.  Acceptance of cookies is not a requirement to use the Service; however, certain features of the Service require your acceptance of cookies to work properly.


Use of Personally Identifiable Information 

We use your PII for the following general purposes:

  • to customize the web pages that you see;
  • to determine your eligibility for Rewards;
  • to inform Members who have made Referrals to you regarding whether or not they have earned a Reward;
  • to inform Members if you are a top earner of Rewards;
  • to fulfill your requests, such as a request to receive Rewards that you have earned;
  • to better understand user behavior and to improve our Service; and
  • to contact you about your membership or with marketing messages we believe may be of interest to you

If we intend on using any PII in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time at which the PII is collected.


Use of Personally Non-Identifiable Information

We may use personally non-identifiable information and pool it with other information to track, for example, the number of fans of a particular artist or song in a given zip code, the total number of users of the Service, the number of users of each page of the Service, and the domain names of our visitors' Internet service providers.  No PII is available or used in this process.


Sharing Personally Identifiable Information

We are not in the business of selling PII.  We consider this information to be a vital part of our relationship with you.  There are, however, certain circumstances in which we may share PII with certain third parties without additional notice to you, including those set forth below:

  1.  Agents, Consultants and Related Third Parties
    We, like many businesses, sometimes hire other companies to perform certain business-related functions.  Examples include mailing information, maintaining databases, hosting services, and processing payments.  When we employ another company to perform a function of this nature, we provide them with the information that they need to perform their specific function.  We require such third parties to maintain the confidentiality of such information and use such information only as necessary to provide us with designated services.
  2. Legal Requirements
    We may disclose PII if required to do so by law or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect and defend our rights or property, (c) act in urgent circumstances to protect the personal safety of users of the Service or the public, or (d) protect against legal liability.
  3. Business Transfers
    As we develop our business, we might sell or buy businesses or assets.  In the event of a corporate sale, merger, reorganization, dissolution or similar event, PII may be part of the transferred assets, and the Privacy Policy may change as a result.


Your Choices

You can always choose not to provide PII to us.  However, doing so will prevent you from using the Service or becoming a Member.



We do not knowingly collect personal data from children under the age of 13.  We will not accept membership requests from, or allow persons under the age of 13 to use the Service.  We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce this Privacy Policy by instructing their children to never provide PII on the Internet without their permission.  If you have reason to believe that a child under the age of 13 has provided PII to us, please contact us, and we will endeavor to delete such information from our databases.


Links to Other Websites

This Privacy Policy applies only to information collected directly by the Service.  It does not apply to information collected by third party websites or products or services that may be linked to by the Service. We suggest that you contact those third parties directly for information on their privacy, security, data collection and utilization policies.  It is the sole responsibility of such third parties to adhere to any applicable restrictions on the disclosure of your PII, and we are not liable for wrongful use of such information by any third party.



We take steps designed to protect PII and to guard such information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction.  However, no Internet or e-mail transmission is ever fully secure or error free.  Please keep this in mind when deciding whether to disclose any PII to us or to any other party via the Internet.


Other Terms and Conditions 

We reserve the right to update or modify this Privacy Policy at any time and from time to time. When we post changes to this Privacy Policy, we will revise the "last updated" date at the top of this Privacy Policy.  It is your responsibility to review this Privacy Policy from time to time and be familiar and comfortable with all of its terms and conditions.  If there are material changes to this Privacy Policy, we will notify you of any such modifications by posting a message on the Service.  Your continued use of the Service after any changes or revisions to this Privacy Policy will indicate your agreement with the terms of such revised Privacy Policy.


Access to Information

To keep your PII accurate, current, and complete, please utilize the functionality of the Service or contact us as specified below.  We will exercise commercially reasonable efforts to update or correct PII in our possession that you have previously submitted to us.
